Terms of Service
Terms for using ThinkToAction, approved and authorized by the Founder to operate. No attorney has reviewed this document.
This document is approved and authorized by the Founder to operate. It has not been reviewed or approved by outside legal counsel.
Status and agreement
These Terms describe the current educational website, the account functionality implemented in code, and the terms of a Founder Edition purchase. ThinkToAction is currently operated by an individual (persona física) based in Mexico; no separate legal entity has been formed. These Terms were approved and authorized by the Founder effective 2026-08-16; they have not been reviewed by outside legal counsel.
Eligibility
The Academy is intended for adults using it for professional education. ThinkToAction is internationally available, subject to applicable law, mandatory local consumer rights, payment-provider availability, sanctions and export restrictions, tax requirements, and other legal or operational restrictions. No minimum age is established in this draft.
Accounts
Account code supports email/password sign-up, verification, recovery, sessions, export and deletion through a managed identity service. The live identity environment has not completed acceptance testing. If accounts are activated, users must provide accurate account information, protect credentials and notify the Academy of suspected unauthorized access.
Educational service
The Academy provides educational content and qualitative practice. It does not guarantee employment, promotion, salary, business outcomes, communication outcomes, certification, or any other professional qualification, unless expressly offered. It does not provide legal, medical, financial, tax, or other regulated professional advice.
Founder Edition purchase
Founder Edition is priced at MXN $1,990 as a one-time individual purchase through hosted Stripe Checkout, offered internationally subject to applicable law, mandatory local consumer rights, payment-provider availability, sanctions and export restrictions, and tax requirements. There is no subscription or automatic renewal.
The purchase includes 30 successful external Reflective Signal evaluations and 15 successful external Executive Mentor analyses. Reflective Signal uses AI only after an explicit request. Provider failures and local-only or deterministic operations do not consume these allowances. No paid top-ups are offered in Version 1.
Access rights
A completed eligible purchase activates server-enforced access with `expires_at` set to null: permanent access to Founder Edition v1 and the Version 1 content included with the purchase. Future major versions may be separately priced. Users may not share credentials, transfer access, or bypass entitlement checks.
Using all included external AI evaluations does not remove Academy access or block non-external-AI learning features. Local-only Mentor remains included.
Refunds
Founder Edition purchases may be refunded within 14 calendar days of purchase, with no usage conditions, without any requirement to prove dissatisfaction. This voluntary policy does not limit, restrict, or waive any mandatory consumer right that may apply under the law of the customer's country of residence. A request does not revoke access. Entitlement changes only after a refund is approved and successfully processed. See the Refund Policy.
AI services
Reflective Signal and Mentor are optional educational aids. Reflective Signal uses AI for structured feedback; it is not a human coach or employee performance assessment. When an external provider is configured and the learner explicitly requests feedback, submitted text may be sent to that provider. Outputs may be incomplete or wrong and require human review. Local/deterministic fallbacks may be available. See AI Usage & Disclosure and Responsible AI.
Acceptable use
Users must follow the Acceptable Use Policy. They must not attack the service, access another person's data, submit unlawful or harmful material, misuse AI, or upload content they lack permission to use.
Intellectual property
This draft states that the Academy intends its text, software and brand assets to be protected to the extent applicable law allows, pending attorney review of the underlying rights; nothing here should be relied on as a settled legal position. Access does not transfer ownership. User-provided text remains subject to the rights and permissions required to operate the requested feature.
Suspension, termination and deletion
Users can initiate account deletion through Account settings. Current database foreign keys cascade account-owned learner and commerce rows, while user references in audit logs become null. That database behavior is not an approved accounting-retention policy. Browser-local drafts remain on each device until cleared. Misuse follows the enforcement model described in the Acceptable Use Policy: a warning, an opportunity to correct, restriction where technically available, and termination for material or repeated violations, with immediate protective action available for fraud, unlawful activity, or serious risk. Only account termination is currently implemented as a distinct enforcement action.
Support and service changes
A single monitored contact channel serves support, privacy, security, accessibility and billing/refund inquiries. Response-time targets have not been approved. The service may change through governed releases, but Version 1 scope and purchased rights cannot be silently altered.
Mandatory local rights
If you are a consumer, you may have mandatory rights under the laws of the country or jurisdiction where you reside. Nothing in these Terms limits, waives, or excludes rights or remedies that cannot lawfully be limited, waived, or excluded. The choice of Mexican law described below applies only to the extent permitted by applicable law.
Disputes
The Founder's stated preference, subject to counsel confirming enforceability, is: (1) contact the Academy directly through the configured support channel; (2) a good-faith informal resolution period of up to 30 calendar days before any formal process, where legally permissible; (3) governmental or consumer dispute-resolution mechanisms available under applicable law, including PROFECO for consumers in Mexico — PROFECO is not represented as the exclusive remedy for consumers outside Mexico; (4) competent courts, subject to mandatory jurisdiction rules that may give a consumer the right to proceed in their own country regardless of any Mexico-law preference. No mandatory arbitration is imposed, and no exclusive Mexican jurisdiction is imposed where mandatory consumer law entitles a customer to proceed elsewhere.
Liability
The final Terms will need a conservative limitation-of-liability structure drafted by counsel. No liability is excluded here that applicable law prohibits excluding, including liability for fraud, intentional misconduct, and any other liability that cannot lawfully be excluded or limited. None of the specific limitation, indemnity, or warranty language is supplied here; it remains attorney work.
